1. Family-based Preference Petitions for immediate relatives (spouses and unmarried childern under 21 years of age of U.S. citizens)

 

2. Preference Petitions

  • First (F1) - Unmarried sons and daughters of U.S. citizens

  • Second (F2A) - Spouses, children, unmarried sons and daugheters of Permanent Residents ("green cards") under 21 years of age. (F2B) - Unmarried sons and daughters of Permanent Residents over 21 years of age

  • Third (F3) - Married sons and daughters of U.S. citizens

  • Fourth (F4) - Brothers and sisters of adult U.S. citizens

 

3. Employment-based Preference Petitions

  • First - Priority Workers

  • Second - Members of the professions holding advanced degrees or Persons of Exceptional Ability

  • Third - Skilled workers, professionals and other workers

  • Fourth - Certain special immigrants

  • Fifth - Employment creation. Reserved for investors in a targeted rural or high-unemployment area

 

NATURALIZATION/CITIZENSHIP

  • Three year eligibility - married to U.S. citizen

  • Five year eligibility

  • Expedited naturalization for military personnel

  • Expedited naturalization for spouses of U.S. citizens working overseas for U.S. corporations engaged in foreign correspondence

  • Exceptions for mental disabilities

  • Issues of good moral character, moral turpitude, previous criminal record, English language proficiency, U.S. history and government test

 

ADJUSTMENT OF STATUS FOR GREEN CARDS - Special Section 245 (i) Waiver

 

REMOVAL OF CONDITIONAL RESIDENCE AFTER TWO YEARS OF MARRIAGE TO U.S. SPOUSE

 

LITIGATION

  • Deportation/removal proceedings before Immigration Court; immigration consequences of criminal convictions; overstays; illegal entries; bond hearings; exclusion; BIA appeals

 

ASYLUM (filed within 1 year of entry)

  • Withholding of deportation; based upon persecution in country of origin (race, creed, religion, national origin, political activities, female genital mutilation, China's one-child policy, honor killings; CAT - Convention Against Torture)

 

CSPA - CHILD STATUS PROTECTION ACT

 

REGISTRY

  • If you entered U.S. before Jan.1, 1972 and remained here

 

DIVERSITY IMMIGRANT (DV) CATEGORY

  • 55,000 annual limit for world-wide lottery
